Terms of Service

1. Agreement to Terms
By accessing or using LaunchPath ("Service," "Platform," "we," "us," or "our"), including our website, dashboard, APIs, MCP server, and any AI agent services we provide, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
LaunchPath is an AI agent deployment platform that enables users to create, train, deploy, and manage AI-powered agents for businesses. The Service includes:
- Creating and configuring AI agents with custom system prompts, personality settings, and model selections.
- Training agents with knowledge bases (website scraping, file uploads, FAQ pairs) for retrieval-augmented generation.
- Adding tools and integrations (webhooks, HTTP APIs, MCP servers, 900+ app integrations via Composio, sub-agents).
- Deploying agents as website chat widgets, WhatsApp bots, voice assistants, and standalone API endpoints.
- Managing client sub-accounts with white-labeled portals, team access, and campaign management.
- WhatsApp messaging features including template management, contact imports, broadcasts, and drip sequences.
- Platform access via the MCP server for integration with developer tools (Claude Code, Cursor, VS Code).
We may update, modify, or discontinue features at our discretion with reasonable notice.
3. Eligibility and Account
You must be at least 16 years old and able to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials, API keys, and channel tokens, and for all activity under your account, including actions taken by AI agents you deploy.
4. Subscription Plans and Billing
4.1 Plans and Pricing
LaunchPath offers tiered subscription plans (Starter, Growth, Agency) with varying feature limits and monthly credit allocations. Plan details and pricing are displayed on our website and during checkout. We reserve the right to change pricing with 30 days' notice to existing subscribers.
4.2 Credits
AI agent interactions consume credits based on the model used and tokens processed. Each plan includes a monthly credit allocation that resets on your billing cycle. Unused monthly credits do not roll over. You may purchase additional one-time credit top-ups that do not expire at the end of the billing cycle.
4.3 Payment
All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information current. Failed payments may result in service restrictions after a grace period.
4.4 Cancellation
You may cancel your subscription at any time via Stripe's customer portal. Cancellation takes effect at the end of your current billing period. Upon cancellation, you retain access to the platform until the end of the paid period, after which your account will be restricted. We do not provide prorated refunds for partial billing periods.
5. Acceptable Use
You agree not to, and not to configure your AI agents to:
- Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
- Deploy agents that impersonate real individuals, government entities, or emergency services without clear disclosure.
- Generate, distribute, or facilitate content that is harmful, abusive, threatening, defamatory, or that exploits minors.
- Send unsolicited messages (spam) via WhatsApp, SMS, or any other channel in violation of anti-spam laws or Meta's policies.
- Use agents to collect personal data without appropriate consent or in violation of privacy laws (GDPR, CCPA, etc.).
- Attempt to gain unauthorized access to our systems, other accounts, or any data not intended for you.
- Scrape, reverse engineer, or automate access to the Service beyond the provided APIs and MCP server.
- Circumvent rate limits, credit metering, plan limits, or other usage restrictions.
- Use the platform to build a competing AI agent deployment service.
- Transmit malware, viruses, or malicious payloads through webhook, HTTP, or MCP tool integrations.
We may suspend or terminate your access if we reasonably believe you have violated these terms, with or without notice depending on severity.
6. Your Content and Data
6.1 Your Content
You retain ownership of all content you provide to the Service, including agent configurations, system prompts, knowledge base content, and contact data. By using the Service, you grant us a limited license to use, process, store, and transmit that content as necessary to provide and operate the platform.
6.2 AI-Generated Outputs
Responses generated by your AI agents are provided for your use. We do not claim ownership of AI-generated outputs. However, AI outputs may be inaccurate, incomplete, or unsuitable for particular purposes. You are responsible for reviewing agent outputs and ensuring they are appropriate for your use case. We do not guarantee the accuracy, legality, or fitness of any AI-generated content.
6.3 End User Data
When you deploy agents that interact with End Users (your customers), you act as the data controller for End User data. You are responsible for: providing appropriate privacy notices to End Users, obtaining necessary consents, complying with applicable data protection laws, and responding to End User data subject requests. We process End User data on your behalf as a data processor under our Data Processing Agreement.
7. WhatsApp and Messaging Terms
If you use the WhatsApp deployment features:
- You must comply with Meta's WhatsApp Business Policy, WhatsApp Commerce Policy, and all applicable messaging laws.
- You are responsible for obtaining opt-in consent before sending messages to contacts, and for honoring opt-out requests promptly.
- Outbound messages (broadcasts and drip sequences) require Meta-approved templates. We are not responsible for template rejections by Meta.
- You must provide your own Meta Business credentials (Phone Number ID, Access Token, Business Account ID, App Secret). We do not provide Meta accounts.
- Message sending is subject to Meta's rate limits and WhatsApp Business API restrictions. We are not liable for delivery failures caused by Meta's systems.
- WhatsApp messages consume credits (0.1 credits per message sent). Credits are deducted at the time of sending.
8. Client Accounts and Agency Use
If you use the client management features:
- You are responsible for your clients' use of the platform through accounts you provision.
- Client portal access, branding, and permissions are controlled by you as the agency owner.
- You must have appropriate agreements with your clients regarding data processing, privacy, and service levels.
- We are not a party to the relationship between you and your clients.
9. Third-Party Integrations
The Service allows you to connect third-party tools and services (via Composio, webhooks, HTTP APIs, and MCP servers). These integrations are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services. You are responsible for configuring integrations correctly and ensuring they comply with applicable laws and the third party's terms.
10. Intellectual Property
LaunchPath and its branding, design, and technology are owned by us or our licensors. These Terms do not grant you any right to our trademarks, source code, or other intellectual property except the limited right to use the Service as described here. Agent templates in the marketplace are licensed under the terms specified by their respective authors.
11. API and MCP Server Access
If you access the Service via API keys or the MCP server, you agree to: keep your API keys and channel tokens secure, not share them publicly, rotate them if compromised, and abide by the rate limits documented in our API documentation. Abuse of API access may result in key revocation and account suspension.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT: THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; AI AGENT RESPONSES WILL BE ACCURATE, COMPLETE, OR APPROPRIATE; WHATSAPP MESSAGES WILL BE DELIVERED; OR THIRD-PARTY INTEGRATIONS WILL FUNCTION CORRECTLY. AI MODELS ARE PROVIDED BY THIRD PARTIES AND THEIR OUTPUTS ARE NOT WITHIN OUR CONTROL.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHPATH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DAMAGES CAUSED BY AI AGENT OUTPUTS, FAILED MESSAGE DELIVERIES, OR THIRD-PARTY INTEGRATION FAILURES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF GREATER).
14. Indemnification
You agree to indemnify and hold harmless LaunchPath and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: your use of the Service; content generated by agents you deploy; your violation of these Terms, applicable laws, or third-party rights; your WhatsApp messaging activities; or your clients' use of the platform through accounts you manage.
15. Account Termination
You may delete your account at any time via your dashboard settings. Upon deletion, all your data (agents, conversations, contacts, channels, campaigns, clients, usage logs) will be permanently deleted. We may also terminate or suspend your account for violations of these Terms, non-payment, or inactivity, with notice where practicable.
16. Changes to Terms or Service
We may modify these Terms or the Service at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes will be communicated via email or a notice in the platform at least 30 days before taking effect. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.
17. General
These Terms constitute the entire agreement between you and LaunchPath regarding the Service. They are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
